One of our core goals as a business is to make the complex simple, and our terms are no exception. Most people skip reading these because they're generally long, boring, and difficult to understand. We've tried everything we can to make ours short and straightforward. We even include a summary line above every section, but be sure to read the full section if you want to know more as the summaries don't provide all the necessary information and are not legally binding.

Welcome to Tatem

Summary: By using Tatem you agree to these terms.

Below are Tatem's Terms of Service. They apply to all Tatem customers. "We," "our" or "us" refers to Tatem Inc. "Tatem" refers to the software products and services offered by Tatem Inc. By choosing to use Tatem, you are agreeing to our Terms of Service, Privacy Policy, and any other policies we post. Please review them carefully. In accordance with our Privacy Policy, we can collect and use your information. For general questions about our terms or our data and privacy practices, email us at [email protected].

Your account

Summary: You must be 18 years or older to create an account. You are responsible for your account.

When you create an account you must provide us with accurate information, in good faith, and you agree to keep your information updated if it changes. To sign up, you must be 18 years or older or have your parent's permission. You are responsible for anything that occurs when someone is signed in to your account, as well as the security of your account. Please contact us at [email protected] immediately if you believe your account has been compromised.

Unacceptable conduct

Summary: Act responsibly and don't violate our policies.

You are responsible for all activity on your account. If you violate our policies we have the right to terminate your account. Don't do anything illegal, that attempts to abuse or circumvent the intended use of Tatem, that misuses Tatem, or negatively impacts Tatem in any way. While this generally covers issues that could arise, anything that you do to hurt us, our products or services, or our customers that is not listed will result in us taking action to prevent it.

Our customers

Summary: You must create an account and subscribe to a paid plan to become a Tatem customer.

To become a customer of Tatem, you must create an account and subscribe to one of our paid plans, as we do not offer a free plan. You can do this by following our onboarding process, adding your preferred payment method, and creating a new workspace. Alternatively, if you join an existing workspace that is already subscribed to a paid plan, you may not need to add a payment method, as the workspace admin will manage billing for all members.

Fees

Summary: Fees will be incurred based on the Tatem subscription you purchase or the workspace you are a member of.

There are subscription fees associated with maintaining a Tatem account. The price of the subscription depends on the plan you have selected. You can choose between monthly subscriptions, where you pay on a monthly basis, or annual subscriptions, where you pay for the entire year upfront. The timing and amount of each subscription depend on the plan you select. You can see the details of what is offered within each subscription plan at the time of selection.

Billing is managed by workspace. Whether you join an existing workspace or create a new one, fees will be billed per member of the workspace. You can view your workspace's current subscription, as well as a history of past payments, by navigating to the Billing page within Settings.

Cancellation

Summary: You may cancel or downgrade your subscription at any time. You are responsible for downgrading your Tatem subscription and / or cancelling your account if you no longer wish to incur charges. You are responsible for the loss of access after you cancel.

As a workspace member, you can leave the workspace at any time and create a new one, or delete your account. However, only the workspace admin can upgrade or downgrade the plan, or delete the workspace.

As a workspace admin, you have the ability to manage the subscription plan for your workspace. You can upgrade or downgrade the plan, or delete the workspace. Upgrading your subscription to a higher plan level will take effect in the current payment term, while downgrading or cancelling your plan will take effect in the subsequent payment term. If you no longer wish to incur fees or charges, it is your sole responsibility to terminate the workspace's subscription. You are responsible for the resulting loss of access for all members of the workspace. Please note that if you delete the workspace, all members will lose access to their subscription, service, and / or account.

Refunds

Summary: We do not offer refunds.

Our policy is that we do not offer refunds. We recommend careful consideration before committing to a subscription.

Restrictions

Summary: Do not share your account information with another person. You cannot use Tatem to create a competitor.

Sharing your account information with another person is not allowed and constitutes a violation of our policies. Additionally, using Tatem to create, or attempt to create, a competing product or service of any kind, whether directly competitive or adjacently competitive, is strictly prohibited.

Account deletion

Summary: You can delete your account by emailing our support team. We can disable your account at our discretion.

You can permanently delete your account at any time by emailing us at [email protected] and requesting account deletion. We can suspend or terminate your account or workspace at any time at our discretion. If a workspace is terminated, all members of the workspace will lose access to the service. We can also cancel any subscription or service at our discretion. You may not bring a claim against us for suspending or terminating your or another person's account or workspace, and you agree you will not bring such a claim. If you try to bring such a claim, you are responsible for the damages caused, including attorney fees and costs. These terms remain in effect even if you no longer have an account or workspace.

Your information

Summary: You are responsible for the information you input into Tatem.

You are able to, and at times asked to, input various details about yourself, your associated parties, and your organization or employer on Tatem. It is your responsibility to input these details accurately to the best of your abilities and knowledge, and you agree to keep the information updated if it changes. Further, it is up to you to keep these details secure. With your permission, we may give other websites or services the ability to verify information about your Tatem account or perform actions on your behalf. This permission is requested when you connect your Tatem account to these other websites or services. For more information, please refer to our Privacy Policy.

Your third-party applications

Summary: You may have to grant Tatem permission to access third-party accounts. You may also revoke that permission.

You may have to grant Tatem access to your third-party accounts, such as Google, in order for Tatem to operate. When you connect your third-party account, that third-party account will present a page that describes the information that Tatem can access. You can revoke our access to those accounts at any time using the respective third-party's security settings page.

Dispute resolution

Summary: If you have a problem please talk to us. Any disputes with us must be resolved in Los Angeles under California law.

We encourage you to contact us if you have an issue. If a dispute does arise out of these terms or in relation to your use of Tatem, then the dispute shall be resolved in the federal or state courts located in Los Angeles, California. Both parties consent to the exclusive jurisdiction and venue of the Los Angeles courts for the purpose of resolving any such dispute. California law, excluding its conflict of law provisions, governs these terms, all other Tatem policies, and any dispute that arises between you and us.

Warranty disclaimer

Summary: We do our best to make sure Tatem works as expected, but that is not always the case.

TATEM IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND. ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY OTHER WARRANTY IS EXCLUDED TO THE GREATEST EXTENT PERMITTED BY LAW. THE DISCLAIMERS OF WARRANTY UNDER THIS CLAUSE ALSO APPLY TO ANY SERVICES WE, OR A THIRD PARTY SERVICE PROVIDER, OFFER ON TATEM.

Indemnity

Summary: If we are sued because of your use on Tatem, you have to help pay for it.

You will indemnify us from all losses and liabilities, including legal fees, that arise from your breach of these terms or relate to your use of Tatem. We reserve the right to exclusive control over the defense of a claim covered by this clause. If we use this right then you will help us in our defense. Your obligation to indemnify under this clause also applies to our subsidiaries, affiliates, officers, directors, employees, agents, and third party service providers.

Everything else

Summary: These terms are the final word on Tatem's policies. By continuing to use Tatem, you agree to our policies.

These terms and any referenced policies are the entire agreement between you and us, and supersede all prior agreements. If any provision of these terms is held to be unenforceable, then that provision is modified to the extent necessary to enforce it. If a provision cannot be modified, it is severed from these terms, and all other provisions remain in force. If either party fails to enforce a right provided by these terms, it does not waive the ability to enforce any rights in the future. We may sometimes make changes to these terms and policies. If we make material changes, we will let you know before the changes come into effect. Continuing to use Tatem after a change means you accept the new terms or policies.
